Terms and conditions of sale

 

 Interpretation

‘Company ‘ means ‘The Bed Factory Ltd’

‘Customer’ means the purchaser of Good from the Company

‘Goods’ means all goods sold and/or delivered by the Company to the Customer

‘Terms’ means these terms and conditions of sale

1.Prices

Prices are determined at the time of order, and prior to payment or deposit, are subject to change without notice.

2.Payment

Payments are to be made to the Company without any deductions or discounts other than those stated prior to placing the order.

If payment is not taken in full at the time of ordering, a deposit of 50% of the Invoice price must be paid when placing the order, unless otherwise agreed by the Company.

Where bespoke goods are ordered with fabrics and sizes selected by the customer, those goods cannot be cancelled by the customer later than 3 days of ordering.

The balance of the Invoice must be paid for in full, prior to, or on delivery.

3.Delivery

The Customer must, within 5 days of being notified of their availability, collect or accept delivery of the goods, unless otherwise agreed with the Company.

If the customer fails to collect or accept delivery within 30 days of being notified of availability, the Company may terminate the contract, keep the deposit and resell the Goods.

In addition, the Company reserves the right to charge the Customer storage on goods not collected after 30 days at the rate of £10 per week.

Every effort will be made by the Company to see that Customer’s goods are delivered on time but if due to circumstances beyond the Company’s control, this is not possible, the Company will not accept liability for failure to meet delivery dates.

4.Inspection

It is the responsibility of the Customer to inspect the Goods on collection prior to taking away, or notify the Company within 2 days delivery of any damages or defects.

5.Cancellations

No order may be cancelled, modified or deferred without the prior consent of the Company (which is at the Company’s discretion) If such consent is given, the Company may charge a cancellation fee of not less than 20% of the Invoice price to recover any losses incurred, including loss of profits.

6.Warranty

All Goods supplied are covered by such warranties as are specified by the Manufacturer

(which is usually a minimum of 12 months from date of purchase)

and supplied subject to the product standards detailed by the manufacturer.
